Terms & Conditions

Clause 1 – Terminology
Agreement: The ZCBS Code for the Implementation of Services shall govern and regulate the contract and relationship between Zürich City Business School (hereinafter referred to as “ZCBS”) and the Student.
Program and Program Material: A distance learning structure devised and developed by ZCBS and/or any Partner, including all changes and updates to such Programs as ZCBS may deem fit and implement at certain time intervals; while the program material consists of all the electronic and physical information, which is subject to changes and updates at the discretion of ZCBS and/or any Partner. The Distance Learning program will be delivered through ZCBS Online Learning Platform.
Parties: refers to ZCBS and Student jointly.
Partner: Any third party institution who provide any part of the service(s) hereunder under the responsibility of ZCBS.
Services: The provision of relevant support, aids, systems, processes, and benefits related to any Course offered and conducted by ZCBS to the Student in delivering the program.
ZCBS: Zürich City Business School, Zürcherstrasse 20, 8952 Schlieren, Switzerland
Student(s): The party receiving the Services to be provided by ZCBS and/or their Partner(s).
Academic Misconduct: All forms of academic misconduct including but not limited to cheating, fabrication, plagiarism, harassment, inappropriate behaviour, language, and/or facilitating academic dishonesty.
Clause 2 – Scope
2.1 The Agreement shall become effective and be binding on the parties at the time of written acceptance of Student´s application for admission by ZCBS and shall govern the relationship between the parties for the period of the Agreement.
2.2 The terms of the Agreement shall constitute the entire contract between ZCBS and the Student on the subject and for all purposes be the final document that supersedes any and all prior communications (in all its forms) between the parties.
Clause 3 – Responsibility
3.1 The course material necessary to achieve the educational goals set forth in the academic curriculum would be delivered by ZCBS. No guarantee is tenable on the Course Material to be errors- or omissions free, and any such claim shall be inadmissible.
3.2 The Student will be responsible for inspecting the Course Material following delivery. Furthermore, the Student will be responsible for notifying ZCBS about any errors or omissions that may come to notice subject to validity of such errors or omissions.
3.3. The responsibility and right to make changes, alterations, modifications, and/or corrections to the content or methods of delivery of Courses lies with ZCBS, if necessary.
3.4 The Course period would not exceed the stipulated number of years from enrolment date. Requests for extension would require to be formally placed for due consideration and for any such extension, fees would be applicable as per Course requirements.
Clause 4 – Payments
4.1 Fees paid for the distance learning Courses and other online services are non-refundable.
4.2 Only full payment as per the Agreement would be considered as fulfillment of the term called Payment. The right to charge and receive a handling fee for late payment at 5% for outstanding dues not paid as per the terms would be levied by ZCBS unless written instructions are obtained upon agreement if any by ZCBS to postpone the date for such payment.
4.3 ZCBS reserves the right to suspend the Student’s access to the Course including but not limited to the ZCBS Online Learning System if payment of any installment or subsequent installments is delayed beyond stipulated number of days.
4.4 ZCBS shall not be obliged to issue the respective Diploma and certificate of completion for the Course enroled until all outstanding dues are settled by the Student.
Clause 5 – Termination
5.1 Termination by ZCBS
Should payment of any invoices issued by ZCBS to the Student be delayed for more than 60 days, ZCBS shall have the right forthwith to terminate the contract under written notification to the Student.
Similarly, ZCBS reserves the right to terminate the contract, without obligation to refund any of the paid tuition fees, in cases of the Student being involved in plagiarism or serious Academic Misconduct in breach of the ZCBS Code.
5.2 Termination by the Student
A Student may terminate this contract upon 30 days written notice without the right for any refund as bound by this code. However, any outstanding dues must be paid in full by the Student for any such termination to become effective.
Clause 6 – Reservation
The Program Material supplied to the Student under this Contract shall always remain the exclusive property of ZCBS. All copyright and other intellectual property rights relating to the Course Material are either owned by or licensed to ZCBS.
All Program Material are protected under Swiss and International copyright laws and conventions and may not be published, copied, sold or otherwise reproduced or distributed without ZCBS’s prior written consent. The Student shall not use the Program Material provided by ZCBS for any other purposes unrelated to the Course.
All Course Work developed by the Student shall remain the exclusive property of the Student. All copyright and other intellectual property rights relating to the Course Work are owned by the Student. The Student grants to ZCBS a non- exclusive license to use and copy the Course Work for any purpose related to the Course.
Clause 7 – Limitation of Liability
ZCBS shall not be liable for any direct or indirect or consequential loss or damage whatsoever (including loss of opportunity) which the student may suffer arising out of or in connection with this contract.
The Services and Course offered by ZCBS do not constitute at any time the right of receiving a Diploma unless all graduation requirements are successfully met.
No guarantee or warranty accrues from the Diploma issued to the Student to constitute a guarantee for enrolment, acceptance, and recognition at other universities, businesses, authorities, or governments. ZCBS neither guarantees nor warrants that the graduation/completion of a Course by a Student and/or the respective Diploma entitle the Student to the use thereof as official or academic title vis à vis authorities, universities or companies and/or in any kind of identity cards, other official documents, business cards, email signatories etc. Students are responsible and thus advised to check with their local authorities on the official recognition of the Course and Diploma.
Clause 8 – Non Disclosure
The Parties are bound by mutual Non Disclosure wherein, any information collected or arising out of the relationship or Agreement are not be disclosed by either party without formal communication to the concerned Party that entails express consent for disclosure.
Clause 9 – Applicable Law and Place of Jurisdiction
This Contract shall be interpreted in all respects in accordance with the laws of Switzerland. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is hereby expressly excluded.
The parties hereby submit to the exclusive jurisdiction of the Swiss Courts for the determination of any question or dispute arising in connection with this Contract. Place of jurisdiction shall be Zürich, Switzerland.
